California campaign finance laws require that communications supporting Proposition 38 that are authorized and paid for by the Prop 38 Committee include the Committee’s “paid for by” disclaimer. A communication is “authorized and paid for” by the Prop 38 Committee under the following circumstances: (1) the Committee pays for the full costs of the communication; (2) the Committee pays for the largest portion of the costs of the communication; (3) the Committee coordinates the expenditure for the communication with a person who pays for the communication and the person does not qualify as a committee themselves; or (4) the communication is an electronic media communication with nominal costs disseminated by the Committee. Paying for a communication includes paying for or promising to pay for the costs associated with design, production, or dissemination of the communication.
Importantly, this means that individuals and organizations coordinating with the Prop 38 Committee to send communications will need to include the Prop 38 Committee’s disclaimer, unless the individual or organization qualifies as a major donor committee or recipient committee. A major donor committee is: “any person or combination of persons who directly or indirectly. . . . [m]akes contributions totaling ten thousand dollars ($10,000) or more in a calendar year to or at the behest of candidates or committees." Nonprofit organizations that contribute more than $50,000 during any 12-month period or more than $100,000 during any four calendar years are generally required to register and report as a recipient committee, unless an exception applies.
